1. Introduction

Welcome to learngerman.ke (referred to as “we,” “us,” or “our”). By enrolling in our online language courses (the “Courses”) and using our website, you agree to abide by these Terms and Conditions.

2. Eligibility and Registration

  • You must be at least 18 years old to enroll in our Courses. Minors may enroll with the consent and under the supervision of a legal guardian.
  • You agree to provide accurate and current information during registration and to keep your login credentials secure. Sharing your account with others is prohibited.

3. Payment

  • Payment Terms: Full payment is required at the time of enrollment unless a payment plan is offered.
  • Non-Payment: Failure to make scheduled payments may result in suspension or termination of access to the Courses.

4. Course Access and Materials

  • You will receive access to course content upon enrollment. Course materials, including videos, workbooks, and supplementary documents, are for personal use only and may not be shared, copied, or distributed.
  • Course access may be time-limited to 10 weeks from the date of enrollment. Extensions may be available for a fee.

5. Intellectual Property

  • All content provided in the Courses, including but not limited to text, graphics, videos, and quizzes, are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or display any Course materials without prior written consent.
  • Unauthorized use of our content may lead to termination of access and legal action.

6. Code of Conduct

  • Respectful Engagement: Students are expected to interact respectfully with instructors and peers.
  • Prohibited Behavior: Harassment, discrimination, or disruptive behavior will not be tolerated and may result in removal from the Course without refund.

7. Disclaimer of Warranties

  • Our Courses are designed for educational purposes only. We make no guarantees regarding language proficiency or specific outcomes.
  • The Courses are provided on an “as-is” basis. We do not guarantee that they will meet your expectations or that the website will be error-free or available at all times.

8. Limitation of Liability

  • To the maximum extent permitted by law, learngerman.ke and its affiliates are not liable for any direct, indirect, or consequential damages arising from your use of the Courses.
  • Our total liability to you for any claim arising out of or in connection with these Terms and Conditions or your use of the Courses shall not exceed the amount paid by you for the Course in question.

9. Course Duration and Extended Access

  • Course Duration: Enrollment grants you access to the Course materials for a set duration of 10 weeks from the date of enrollment.
  • Completion Deadline: You are expected to complete the Course within this time period. After the course duration expires, access to the remaining lessons will no longer be available.
  • Extended Access: If you have not completed the Course by the expiration date, you may choose to continue by paying an additional fee per lesson to access any remaining content.
    • Additional Lesson Fee: The fee for each additional lesson will be 1000 Kshs. (or a discussed amount)
    • Extended Access Request: To resume the Course, please contact us at info@learngerman.ke to arrange payment for the lessons you wish to access.
  • learngerman.ke reserves the right to modify or update the additional lesson fee and terms of extended access at any time.

10. Attendance and Missed Live Sessions

  • Live Lesson Attendance: Students are expected to attend all scheduled live lessons as part of their commitment to the Course.
  • Missed Sessions: If a student misses a live lesson, they are expected to review the recorded lesson materials (if available) and complete any assignments or activities on their own. This responsibility to catch up applies unless the lesson was postponed or rescheduled by the tutor.
  • Notification Requirement: Students must provide adequate notice if they are unable to attend a live lesson. Notification should be sent to your tutor at least 2 hours in advance.
  • Special Arrangements for Valid Reasons: If a student has a valid reason for missing a live lesson (such as medical or family emergencies), they may request a special arrangement. We will consider requests on a case-by-case basis, but any rescheduling or additional session is subject to availability and at the discretion of the tutor.

11. Privacy Policy

  • By using our website and enrolling in our Courses, you agree to the collection and use of your personal information as outlined in our Privacy Policy.

12. Amendments to Terms

  • We reserve the right to amend these Terms and Conditions at any time. Notice of changes will be posted on our website. Continued use of the Courses after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.
